Welcome to Swipelooks! These Terms of Service ("Terms") govern your access to and use of the website and SPA application located at https://swipelooks.app. Swipelooks is operated by GoldBay Capital LLC ("GoldBay", "we", "us", or "our").

Please read these Terms carefully before using the application. By accessing Swipelooks, you confirm that you are at least 18 years old and agree to be bound by these Terms.

1. Description of Service

Swipelooks provides an AI-powered virtual try-on web application that allows users to visualize digital clothing on uploaded or pre-set images ("Service"). The technical core of the service is powered by Google Cloud Platform and Vertex AI.

2. User Accounts and Content

Registration: You must authenticate via Google Sign-In to use certain features. You are responsible for maintaining the security of your session.
Image Upload Rules: You are solely responsible for any photos you upload. You strictly represent and warrant that you own the rights to the uploaded image or have explicit permission from the person depicted in the photo.
Prohibited Content: You may not upload images containing nudity, explicit material, violence, or copyright-protected content that does not belong to you. We reserve the right to terminate your account for violating these rules.

3. Geographic Restrictions (Illinois BIPA Notice)

Swipelooks is not offered to users located in the State of Illinois, United States. Do not access or use the Service while located in Illinois. We may use reasonable technical safeguards to enforce this restriction.

Swipelooks does not use uploaded images for biometric identification or facial-recognition purposes. This restriction does not limit any privacy rights that may apply under law.

3.1. Payments, Swipe Passes, and Refunds

Swipe Passes are one-time purchases. They are not subscriptions and do not create recurring or automatic charges.

Merchant of Record: Purchases are sold by Pixel Rainbow Inc., acting as Merchant of Record. Pixel Rainbow Inc. is the seller of record for payment transactions and handles payment processing, receipts, applicable taxes, and payment-related refunds.
Payment processing: Pixel Rainbow Inc. and its payment partners, including Stripe where applicable, process payment information. GoldBay Capital LLC does not receive or store full payment-card details.
Refunds: Purchases are generally final after the paid access has been made available, except where a refund is required by applicable law or a payment was processed without the corresponding paid access being granted.
Support: If a payment was completed but paid access was not granted, contact [email protected] within 14 days of the transaction. We will investigate and coordinate any appropriate remedy with the Merchant of Record.

4. Artificial Intelligence Disclaimers

AI-Generated Content: The clothing try-on images are generated entirely by Artificial Intelligence (Vertex AI). Due to the nature of machine learning, visual outputs are simulations and may not perfectly reflect real-life fabrics, fits, or colors.
No Guarantees: GoldBay Capital LLC does not guarantee that the generated images constitute an exact or error-free representation of clothing items.

5. Limitation of Liability

To the maximum extent permitted by law, GoldBay Capital LLC and its officers shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use or inability to use the Service, including visual errors generated by the AI model. The Service is provided on an "AS IS" and "AS AVAILABLE" basis.

6. Intellectual Property

The Swipelooks interface, software code, algorithm design, trademarks, and branding are the exclusive property of GoldBay Capital LLC. You may not copy, reverse-engineer, or modify any part of the application.

6.1. Trademark Disclaimer

Amazon and the Amazon logo are trademarks of Amazon.com, Inc. or its affiliates. Swipelooks is an independent service and is not directly affiliated with, authorized, or endorsed by Amazon.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict of law provisions.
